Italy switches on AI Act fines on 23 October — most of its companies are not ready

After passing the EU's first national AI law (Law 132/2025), Italy completed the enforcement layer: decree 179/2026, in force on 23 October, names ACN as market-surveillance authority, AgID for notified bodies and the Bank of Italy, CONSOB and IVASS for finance, with fines up to €35M or 7% of turnover. Only nine of 27 member states have finished this step. Adoption is the weak point: two in three SMEs do not use AI in a structured way and only 30% of firms have adequate governance for AI agents. On compute, Domyn's ~$1.1bn (mostly debt) is expanding the Colosseum supercomputer.

This week

01

AI Act fines from 23 October

Decree 179/2026 gives ACN, AgID and the financial supervisors their powers; SMEs pay the lower of the fixed amount or the turnover percentage, and minor breaches can end in a remedy order instead of a fine.

02

Rules ahead of readiness

Only 30% of Italian firms have adequate governance for agentic AI, and 56% of SMEs invest under 0.5% of revenue in AI — the compliance gap is now a sales opportunity for advisers.

This month

01

Sovereign compute, debt-financed

Domyn's ~$1.1bn, mostly debt, shows how Europe pays for GPUs without US-scale equity.

02

The national layer takes shape

Decrees naming AgID and ACN as authorities, with mandatory AI training and liability rules, complete Italy's law.

What to watch next
  • First ACN investigations and fines after 23 October
  • Colosseum's go-live and first customers
  • Use of the €1B fund
What to do

If you operate in Italy, the AI Act is enforceable now: keep an AI inventory, label chatbots and deepfakes, set up serious-incident reporting and check the national sector rules (health, employment, professions).

Italy pre-approves the decrees implementing its national AI law (authorities, training, biometrics, liability)

The decrees designate AgID and ACN as national authorities and add mandatory AI training and civil-liability rules; final adoption was expected by October 2026. Italy is the first EU country with a national AI law on top of the AI Act.

EU delays AI Act high-risk rules: stand-alone systems to Dec 2027, embedded AI to Aug 2028

The Digital Omnibus deal also adds a ban on AI 'nudifiers'. Transparency duties (chatbot disclosure, labelling) largely keep their dates — don't relax on those.
